There is reason to believe the individual has a mental illness and cannot determine or refuse if care is needed
The individual is mentally or emotionally impaired to the extent that they cannot come to reality or control emotions or actions
The Baker Act law was established in 1972 to help for involuntary examinations and holds for the treatment of individuals who are suffering with mental illness.The Baker Act allows a Law enforcement officer or Mental Health professional to admit or refer a individual who he/she believes that they are in danger to themselves and/or others or are unable to proper care of themselves. The Baker act was enacted for a person who is suffering from a mental illness and/or is not willing to receive or seek treatment. This hospitalization act is only applicable for the state of Florida.
